Refer and Earn Program Terms and Conditions

Welcome to the Cowan Real Estate Refer and Earn Program (the “Program”). These Terms and Conditions outline the rules for participation and eligibility for the $1,500 Visa Gift Card (“Reward”). By participating in this Program, you (“Referrer”) agree to the following terms.

This Program is offered by David Cowan of Cowan Real Estate – Powered by eXp, operating in the Hunter Valley, New South Wales, Australia.

1. Program Eligibility

1.1 You will qualify for the Reward if:

The person you refer (“Referee”) lists their property exclusively for sale with David Cowan of Cowan Real Estate – Powered by eXp.
The referred property successfully sells and settles within 12 months of the referral date.

1.2 The property must be sold under a valid agency agreement between the Referee and Cowan Real Estate – Powered by eXp.

1.3 Rewards are issued only after settlement of the referred property.

2. Submitting a Referral

2.1 Referrals must be submitted via the official Cowan Real Estate referral form. The following information is required:

Your full name and contact details
The Referee’s full name, property address, and contact details

2.2 By submitting a referral, you confirm that:

You have obtained the Referee’s permission to share their contact details for the purpose of this Program.

3. Reward Details

3.1 Only one Reward will be issued per referred property, regardless of how many individuals submit a referral.
3.1.1 In the event of multiple Referrers claiming the same Referee, the Reward will be granted to the first valid submission received, based on the timestamp of the official referral form.

3.2 The Reward is non-transferable and cannot be exchanged for cash or other items.

3.3 Rewards will be issued within 30 days of settlement.

3.4 The Reward is personally funded by David Cowan and will not be deducted from the agency commission.

4. Program Conditions

4.1 Referrals are valid for 12 months from the date of submission. If the property does not sell and settle within this timeframe, no Reward will be issued.

4.2 Cowan Real Estate – Powered by eXp, along with David Cowan, reserves the right to:

Verify the eligibility of any Referrer or Referee
Decline any referral that does not comply with these Terms and Conditions

4.3 In the event of a dispute, the decision of Cowan Real Estate – Powered by eXp will be final.

4.4 Compliance with Property and Stock Agents Act 2002 (NSW)

David Cowan and Cowan Real Estate – Powered by eXp operate in full compliance with Section 47 of the Property and Stock Agents Act 2002.

Licensed agents are required to disclose the following information when referring a seller to third-party service providers:

Relationships: The nature of any relationship the agent has with the referred service provider.
Consideration: Any monetary or non-monetary consideration derived or expected from the referral.
Benefits: Any benefits received or expected in connection with promoting or facilitating the sale.

Note for Referrers:

To ensure transparency and avoid conflicts of interest, Referrers must disclose any significant personal or commercial relationship with the seller at the time of referral.

If a Referrer is:

A family member of the seller; or
Has a direct financial interest in the sale (including receiving payment, gifts, or benefits beyond this Program), they must disclose this at the time of referral.

Referrers with a direct financial interest in the sale of the property will not be eligible to receive the Reward.

This commitment ensures full compliance with applicable legislation and ethical real estate practice.

5. Privacy

5.1 Any personal information collected for this Program will be handled in accordance with the privacy obligations of Cowan Real Estate – Powered by eXp.

5.2 By participating, you consent to your personal information being used for:

Verifying referrals
Administering the Program
Delivering Rewards

5.3 Your information will not be shared with third parties except as required by law.

6. Liability

6.1 Neither David Cowan nor Cowan Real Estate – Powered by eXp will be responsible for any loss, damage, or expense arising from participation in the Program unless required by law.

6.2 These Terms do not limit any rights protected under Australian Consumer Law.

7. Changes to the Program

7.1 Cowan Real Estate – Powered by eXp reserves the right to modify, suspend, or terminate this Program at any time without prior notice.

Changes will not affect referrals submitted before the changes take effect.
